Mary Jane (MJ) Wilson-Bilik is a technology, privacy and insurance regulatory law partner at Eversheds-Sutherland (US) in Washington DC.

She serves as head of the firm’s US artificial intelligence (AI) practice in financial services, and co-chair of its Global AI in financial services practice.

For more than 25 years, MJ has advised her financial services and technology clients on privacy and innovation issues. Her recent focus has been to assist clients perform AI impact assessments and develop robust risk management, governance and vendor management policies for their AI efforts, including generative AI. She counsels clients on assessing AI risks on a cross-sector basis, monitoring for bias, privacy, cybersecurity, intellectual property and specialized regulatory risks, and implementing effective governance measures and guardrails. MJ is a frequent speaker at conferences and client meetings on privacy, risk management and artificial intelligence, including generative AI.

MJ received her PhD in quantitative political science from Columbia University and her J.D., magna cum laude, from the Georgetown University Law Center.

  • Advised a large insurance company on whether the company can accept crypto as payment.
  • Advises on corporate responsibilities associated with cryptocurrencies and digital assets.
  • Advises on whether or not the arrangement associated with the product (cryptocurrency or digital asset) is considered an investment company and therefore required to be registered with the SEC.
  • Advises on whether or not a product (cryptocurrency or digital asset) is considered a security by US regulatory bodies (SEC).
  • Advises on whether products (cryptocurrencies or digital assets), if securities, fall under SEC or CFTC purview.
  • Provides comprehensive cybersecurity and privacy compliance advice to an energy industry insurer, including on regulations by NAIC and the New York State Department of Financial Services.
  • Advising financial services corporations and their boards on the NY Department of Financial Services Cybersecurity Regulation, current and proposed SEC cybersecurity requirements, and global privacy rules.
  • Conducted an in-depth analysis and provided recommendations on a series of key cybersecurity and privacy policies affecting an insurance company's members.
  • Advises a supplemental insurance provider on the GDPR implications of a potential new strategic venture.
  • Advises a leading life reinsurance company on its cybersecurity program, including vendor due diligence, incident response and compliance with the New York State Department of Financial Services cybersecurity regulation.
  • Advises insurers, investment companies, and banking and financial services corporations regarding the effectiveness and regulatory acceptability of their cybersecurity/privacy plans, programs and policies.
  • Conducted a privileged information security assessment for a retirement benefits provider with the assistance of a major computer security consultancy firm.
