Melissa Fox represents clients in business and commercial litigation matters and advises clients in connection with regulatory compliance issues. 

Melissa leverages her experience as a litigator to help clients manage risk and navigate global regulations when launching novel products and disruptive technology. Melissa's experience includes defending class action lawsuits, conducting internal investigations and representing clients in a variety of proceedings in state and local courts.

Melissa defends major insurance companies, financial industry participants, technology companies, food and beverage manufacturers and educational institutions in class action lawsuits and other complex litigation. Melissa has extensive experience advising clients on privacy, cybersecurity and artificial intelligence matters and litigating disputes in this area. Melissa advises clients in internal investigations and those brought by state and federal regulators. Melissa also has experience representing national and regional law firms in professional liability matters arising out of corporate transactions, franchising, securities, trusts and estate planning and litigation, among other practice areas.

As a member of Eversheds Sutherland’s Cannabis Industry team, Melissa counsels a variety of clients on the rapidly changing patchwork of state and federal laws affecting this industry. Melissa helps ancillary-service providers assess risk and navigate this complex regulatory landscape to meet their business needs.

 
  • Analyzing and providing risk mitigation strategies to a Fortune 50 technology company in connection with creating, developing and launching advertising products and features in virtual reality and augmented reality.
  • Advises a leading global publicly traded technology company on privacy and competition in connection with development of advanced new products.
  • Advising a Fortune 50 publicly traded technology company on breach response in over 24 global jurisdictions, including 50 US states, Puerto Rico, the UK and the EU, as well as proactively advising on privacy for the development of advanced new products.
  • Counseled insurance providers with respect to underwriting insurance for various types of cannabis businesses and ancillary service providers to the cannabis industry.
  • Currently representing automobile insurer in 16 putative class actions relating to total loss claim settlements.
  • Represents and defends an international pharmaceutical company in a products liability action based on the theory of innovator liability.
  • Defended an AmLaw 50 law firm against claims of professional malpractice, breach of fiduciary duty and fraud.
  • Represents and defends a group of underwriters in a putative class action brought on behalf of purchasers of preferred shares in a failed energy company.
