Sutherland Partner Stephen P. Kranz is speaking on a Performance Marketing Association Industry Report podcast entitled "Sexy Advertising Tax Talk," March 15, 2010. The discussion centers on the legal definition of nexus. Steve will talk about how nexus is currently being applied to Internet companies; how affiliates are different when it comes to establishing nexus; whether states that have enacted the ad tax can be challenged on a constitutional level; and what are the arguments on both sides. He will also discuss how nexus can be enforced without passing these ad tax bills, alternatives to the ad tax (such as the Streamlined Sales Tax initiative); and statutes being proposed by the Multistate Taxation Commission and how those could impact affiliates and merchants.

This podcast is a new episode of  the Performance Marketing Association Industry Report, which is dedicated to the most pressing issues impacting advertisers, publishers, networks and agencies.
