Sutherland Quick Call

James M. Cain, Daphne G. Frydman and Mary Thornton Payne – all members of Sutherland's ETF Team – are hosting a Quick Call, March 15, 2012. Their presentation, titled "New CFTC Rules Affecting Funds that Invest in Commodity Interests: How Will They Affect You?," examines the recently adopted amendments by CFTC to its regulations governing the registration of commodity pool operators (CPOs) and commodity trading advisors (CTAs) and the compliance and reporting obligations that accompany registration. As a result of these amendments, some registered investment companies that engage in commodity transactions but were previously excluded or exempt from CFTC regulation, and their advisers, may become subject to the CFTC's jurisdiction. The CFTC also proposed regulations that are intended to harmonize certain compliance requirements with SEC regulations and will likely ease compliance burdens for dual SEC/CFTC registrants.
