With extensive experience in complex construction disputes, Abbie regularly counsels owners, general contractors, developers, project managers, design professionals, and subcontractors in connection with contract drafting and negotiation; federal and state contract compliance; construction and design defect claims; change order and scope claims; differing site conditions; performance and warranty disputes; defaults and termination; payment issues; surety claims; lien and bond claims; delay and liquidated damage issues; risk management; bankruptcy issues; and bidding and bid disputes.
- Obtained settlement for an industrial prime contractor from a global owner in an arbitration concerning defective engineering, labor productivity and delay issues and requiring detailed critical path analysis.
- Represented a national subcontractor in an airport expansion project concerning contract and payment disputes related to prevailing wage rates.
- Obtained a favorable settlement for general contractor against construction management company (hired by the owner) for fraud and related claims concerning construction of several buildings on a military base.
- Obtained an arbitration victory, including attorneys’ fees and costs, for general contractor in suit involving breach of contract claim against subcontractor related to the construction and installation of an OSHA-approved HVAC system in a gun range.
- Represented a large multi-state general contractor in several disputes concerning defective work, delays and other damages on construction of public elementary and secondary schools.
