Garrett A. Gibson

Garrett Gibson is a trial attorney.

He represents a variety of clients, from individuals to the world’s largest companies, in complex construction and business disputes across the country. Garrett has tried multiple jury trials, bench trials and arbitrations to final judgment, and handled numerous appeals in both state and federal courts, including two successful arguments before the Supreme Court of Texas. Garrett has built a reputation for distilling complex issues into concepts that judges, juries and arbitration panels can easily understand.

Garrett has significant experience representing owners and contractors on a variety of large-scale construction disputes across a variety of sectors, including alternative energy projects, residential facilities, pipelines, power plants and gas processing facilities. He has handled complex claims related to changes, delays and liquidated damages, project cost accounting, design and construction defects and mechanics liens. He advises on project execution, including management of contractor defaults and terminations, and surety bond administration.  

A considerable part of Garrett’s practice involves resolution of business disputes, including high-stakes shareholder and joint venture disputes, breach of contract claims, trade secret claims, non-compete disputes, fraud claims and class action lawsuits. In addition to his litigation and trial work, Garrett also has experience conducting sensitive internal investigations for companies in the energy, construction, finance, manufacturing and tech sectors, including investigations concerning alleged FCPA violations, accounting fraud and violations of company policy.

Prior to joining Eversheds Sutherland, Garrett was an associate at a litigation boutique in Houston. His previous experience includes serving as a law clerk for Justice John P. Devine on the Supreme Court of Texas.

  • Represented the EPC Contractor for a natural gas pipeline project in the Pacific Northwest against a subcontractor.
  • Represented a publicly-traded Austrian company in a dispute with a shareholder over a minority shareholder buy-out payment.
  • Represented the EPC Contractor for a natural gas fired power plant in a two-week jury trial in Montgomery County, Maryland against a terminated subcontractor.
  • Represented the owner of a senior care living facility in North Carolina in a dispute with the Project construction manager in a week-long AAA arbitration.
  • Argued and won a unanimous Texas Supreme Court victory on behalf of a publicly-traded company in a precedent-setting decision that clarified the mandamus standard for dominant jurisdiction. In re J.B. Hunt Transp., Inc., 492 S.W.3d 287 (Tex. 2016).
  • Argued and won a unanimous Texas Supreme Court victory on behalf of a construction company that had performed repair work following Hurricane Ike. Byrdson Services, LLC v. S. E. Tex. Reg’l Planning Comm’n, 516 S.W.3d 483 (Tex. 2016).
  • Represents a global manufacturing company in significant litigation stemming from the termination of a company executive.
  • Represented a construction manager in a dispute arising from the construction of a $75 million senior care facility and in a subsequent dispute following hurricane flooding at the facility.
