John Hays practices complex business litigation.

He represents clients in disputes related to various labor and employment matters, including non-compete and trade secret issues.

John’s varied experience also includes advising employers and corporations during pre-suit investigations and litigation related to compliance with the Fair Labor Standards Act (FLSA) and controversies regarding wage and hour cases, worker classification matters, and harassment, retaliation and discrimination.

In addition, John has extensive experience defending whistleblower retaliation claims related to the Sarbanes-Oxley Act of 2002 (SOX), the Pipeline Safety Improvement Act (PSIA), and various other whistleblower statutes enforced by the Occupational Safety and Health Administration (OSHA).

Prior to joining Eversheds Sutherland, John served as a labor and employment associate in a regional law firm in Houston.

John is a disabled veteran who was medically retired as a Gunnery Sergeant after 17 years of service as an infantryman in the United States Marine Corp, where he completed multiple combat deployments, among many other accomplishments.

John is admitted to the State Bar of Texas. He has submitted his application to The District of Columbia Bar. His work is supervised by District of Columbia Bar members.

  • Won summary judgment for a storage facility in an FLSA overtime and retaliation case.
  • Won dismissal of a defamation lawsuit for a former employee of our client, who was named in her individual capacity in the litigation.
  • Won summary judgment for a multinational chemical company in litigation involving claims including of race and age discrimination under federal and state laws, as well as retaliation claims under FMLA.
  • Represents a global manufacturing company in significant litigation stemming from the termination of a company executive.
  • Defends an energy infrastructure company against a whistleblower retaliation claim initiated by a former employee under the Pipeline Safety Improvement Act.
